DAC6 / EU Mandatory Disclosure Regime - A practical approach

Course Description:

Taking into consideration the recent adoption of the DAC6 Directive by the European Union with regards to the mandatory automatic exchange of information in the field of taxation, and particularly in respect of reportable cross-border arrangements, as well as its forthcoming transposition into a national legislation (which will automatically apply on all providers of legal, accounting, corporate, administrative and other relevant professional services), there is an immediate and imperative need for training of a large number of professionals, in light of ensuring the correct application of the provisions of the Directive, in all affected sectors.  

 

Course Objectives:

Following completion of the relevant seminar, the professionals of all sectors in which the provision of services must be in line with the provisions of this particular European Directive (and the relevant harmonizing legislation) for obligatory exchange / disclosure of information for cross-border arrangements (DAC6), will be in a position to:

 

  1. Name all basic provisions, relevant terminologies and deadlines for submitting information, as well as the relevant administrative fines which will occur in case of non-compliance with the relevant Directive / legislation.
  2. Will be in a position to express an opinion in respect of the classification of cross-border arrangements and to classify the relevant arrangements according to the hallmarks of the relevant Directive / legislation.
  3. To evaluate the potential application of the provisions of DAC6 on the cross-border arrangements which took place / are known to them while carrying out their activities.
  4. To explain the relevant Directive / legislation to customers and associates.
  5. Will be in a position to evaluate, justify and document their evaluation in respect of the degree to which a cross-border arrangement under examination falls under any of the Hallmarks, as provided by the Directive / legislation.
  6. Will be in a position to explain the particular Hallmarks based on which the obligation of reporting a cross-border arrangement will be evaluated.
  7. To defend their position in terms of the classification of cross-border arrangements.
  8. To justify and support the relevant classification of those, as well as be in a position to
  9. Co-operate with other intermediaries (located in other EU member states) which were also participants in a relevant cross-border arrangement in order to agree on the treatment of such arrangement, based on the Hallmarks.

Professionals employed in sectors where the provision of services must be in line with the provisions of the European Directive for obligatory disclosure / exchange of information for cross-border arrangements (DAC6 and the relevant harmonizing legislation), including lawyers, accountants, tax advisors, auditors, providers of corporate / administrative services, and in general every person who designs, markets, organises or administers the implementation of a reportable cross-border arrangement.
